1. What is legal here, in your opinion, and why? (Granted, none of us are lawyers.)

2. What is ethical here, in your opinion, and why? (We are, however, all entitled to make ethical arguments.)

3. Is there anything specific that could have been done better so as to avoid this difficulty?
